Our Expert Management Team:

Gordon Ashford is a Senior Claims Consultant with 50 years’ experience in construction, including a decade in the Middle East working on MEP and specialty projects. He is a registered expert with the GCC Commercial Arbitration Centre in Mechanical and Electrical Engineering, with sector experience in power, hospitals, commercial, retail, transportation, and aviation.

Will Taborn spent 30 years at leading law firms, working with top KCs, juniors, and senior leaders in the UK legal industry. He was integral to one of the first successful Alternative Business Structure (ABS) law firms in the UK, which led to the formation of Taborns – a specialised legal services provider.

Jon Tucker has over 30 years’ experience as a Quantity Surveyor specialising in MEP and special project disputes. He has worked in UK, Europe, the Middle East and the Caribbean. He divides his time between London and Grand Cayman, where he manages regional and US expert enquires.

Construction Industry Corporate Board Expert

Background

Middleton Taborns were approached to supply two law firms a joint expert concerning a regulatory investigation and prosecution of a high profile corporate collapse within the construction industry.

Requirement

The personnel requirement was the need of a construction industry expert with a background, and knowledge, of :

Board governance within the construction industry.

The role of the Financial Director within the industry.

Knowledge of financial control and industry norms.

How future revenue is registered.

Knowledge of operations in UK. Middle East Canada.  

An understanding of IAS (International Accountancy Standards)

The purpose of the instruction was to enable those instructing to provide advice to both clients in relation to the preparation of their written representations in response to an FCA Warning Notice.

Kathmandu International Airport in Nepal

Background

Our client was acting for an international contractor who contract was terminated from an aviation expansion project in Kathmandu, Nepal. The owner of the airport was claiming for lost profit because of delays to the expansion. The allegation is more and larger aircraft would have been able to use the expanded airport which would have resulted in significantly more profit over the next 5-8 years. 

Requirement

Middleton Taborns were asked to provide a specialist aviation expert with: 

Experience of operating or advising international airports on their commercial operations. 

Knowledge of how airports generate revenue and profit. 

Ability to analyse passenger growth projections and statistics and the impact on projected revenue and

Outcome

Middleton Taborns Expert prepared and diligently completed their quantum report, which greatly assisted   the client and defence of the Arbitration.

Caribbean Hotel Roof

Background:  

Middleton-Taborns were asked if they could provide a construction Expert to assist on a matter related to a newly built 5-star Hotel in St Kitts. The hotel owner was in dispute with the builder of the property as to whether the specialist materials and construction of the hotels roof was to CAT 5 (Hurricane) standard as specified in the contract.  

Requirements

The Architectural expert was instructed to prepare an independent expert report which required: 

An overview and comparison of the technical specifications of a certain type of shingles including Class 5 Hurricane Standards and fire resistance requirements, for use on a hotel project, including meeting the “design brief” in terms of durability, maintenance cost effectiveness, aesthetics and overall suitability for a large-scale, five star branded, luxury, beach front hotel project.

Outcome   

Middleton Taborns expert produced a technical report in preparation for trial at the Technology and Construction Court and settlement was achieved between both parties before the hearing commenced. 

MEP Piping Installation Nuclear Power Station

Background   

Middleton-Taborns received an urgent enquiry in regard to an pending Adjudication regarding a confidential engineering matter at a UK Nuclear Power Station.   

Requirements

Middleton-Taborns were asked to provide an expert with extensive experience from the MEP and Nuclear engineering sectors. The works involve installing the processing pipe and equipment, as well as all the utilities (process air, water etc) and our expert needed to opine on the extent to which various acts fell foul of good industry practice.

Outcome

Middleton-Taborns provided an MEP and Nuclear engineering expert with over 35 years experience in the industry. Their expert report played a key part in the Adjudication process and the technical aspects of the case.

The hearing resulted in a very successful outcome for the client.
